Public Adjuster, Contractor, Attorney, or Appraiser: Who Does What

A clear explanation of different roles in property damage claims.

Public Adjuster

A public adjuster is a licensed professional who represents the policyholder — not the insurance carrier — in preparing, documenting, and negotiating a property insurance claim. Public adjusters review the policy, inspect and document the damage, prepare a detailed scope and estimate, and communicate with the carrier on the policyholder's behalf. In most states, including Texas and Florida, public adjusters must be licensed and are regulated by the state department of insurance. A public adjuster is paid from a percentage of the recovery, as agreed in the public adjuster contract. Representation begins only after the public adjuster contract is signed by both parties.

Contractor

A contractor is a licensed professional who performs physical repairs, reconstruction, or remediation on the damaged property. Contractors provide estimates for repair costs and can offer opinions about the scope of damage, but they are not licensed to adjust claims or represent policyholders in claim negotiations. A contractor's estimate is an important piece of documentation in the claim process, but the contractor's role is to perform the work, not to advocate for the policyholder in claim disputes. Some contractors may offer to negotiate with the carrier, but in many states, unlicensed claim negotiation or adjusting is prohibited.

Attorney

An attorney is a legal professional who represents clients in legal matters, including insurance coverage disputes, bad faith claims, and litigation. Attorneys handle legal questions such as whether coverage exists under the policy, whether the carrier has acted in bad faith, and whether litigation is appropriate. Attorneys are not adjusters, estimators, or construction professionals, though they may work with experts in those fields. Most property claim disputes are resolved without litigation, and an attorney is not always necessary simply because a claim is disputed.

Insurance Appraiser

An insurance appraiser is a qualified professional selected by one party in the appraisal process — a policy provision that resolves disputes about the amount of loss. Each side selects an appraiser. The appraiser evaluates the damage and the cost to repair or replace covered property. If the two appraisers cannot agree, an umpire is selected, and agreement by any two of the three determines the amount of loss. The appraiser's role is specific to the appraisal process and is distinct from the role of a public adjuster, though some professionals hold both licenses. White Rock Public Adjusting, LLC founder Gyorgy Toldy is a licensed public adjuster and insurance appraiser.

Carrier Adjuster

The carrier adjuster — sometimes called a company adjuster or staff adjuster — works for the insurance carrier. Their role is to investigate the loss, assess damages, and determine the amount the carrier believes is owed under the policy. Carrier adjusters may be employees of the insurance company or independent adjusters contracted by the carrier. In either case, they represent the carrier, not the policyholder. A carrier adjuster may be professional and thorough, but their interests are aligned with the carrier, not with the policyholder.

Engineer or Consultant

In some claims, an engineer, roofing consultant, or other technical expert may be retained — by the carrier, by the policyholder, or by the public adjuster — to evaluate specific technical questions. An engineer might assess structural damage, determine causation, or evaluate whether damage is consistent with a particular event. The engineer provides a professional opinion based on technical analysis, but the engineer does not adjust the claim or decide coverage.

Why Roles Should Not Be Confused

Each role has a distinct function, licensing requirement, and scope of authority. Confusing them — for example, relying on a contractor to negotiate the claim or expecting an attorney to estimate repair costs — can lead to gaps in the claim process. A well-managed claim often involves multiple professionals, each contributing in their area of expertise. Understanding who does what helps property owners make informed decisions about when to involve each type of professional.
