Insurance claim denied? Start with the denial letter.

A denial is a written position. Before anyone can say anything useful about it, that position has to be read: what exactly was denied, on what basis, and relying on what facts. Very different denials can look identical in a summary paragraph.

Your issue is preselected as a denied claim. We do not tell you a denial is wrong before reading it.

A denial is not a conclusion about your loss.

It's a statement of the carrier's reasoning.

Reasoning can be examined: the provision cited, the facts assumed, and the documentation it relied on are all identifiable in the file.

What we work to understand first

  • Exactly what was denied — the whole claim, or specific items
  • The policy provision or provisions cited
  • The facts the carrier relied on
  • Reports used, including engineering or cause-and-origin
  • The carrier's causation position
  • Exclusions relied upon
  • Limitations, conditions, and time requirements
  • What documentation already exists in the file
  • What documentation was never submitted

Partial denials are their own problem

Many letters approve part of a loss and deny another part — one slope but not the other, water damage but not the cause of the water, structure but not contents. Partial denials often hinge on scope and causation, which are documentation questions rather than opinions.

We will not tell you the denial was improper before reviewing it, and we will not promise a reversal. We are also not a law firm and do not give legal advice — if your situation appears to call for counsel, we will say so rather than talk around it.
